Terms and Conditions
PAYMENT TERMS: Net 30 Days.
SERVICE CHARGE: All amounts not paid within thirty (30) days of date of invoice will accrue a service charge in the amount of two percent (2) per month or the highest rate consistent with applicable usury laws (if less than 2% per month) and will be compounded each month in which the invoice, or any part thereof, remains unpaid.
COLLECTION COSTS: Purchaser agrees to pay all collection costs incurred by Able Hose & Rubber in collecting unpaid amounts, including attorney fees, witness fees (expert and otherwise) and all out-of-pocket costs.
SECURITY INTERESTS: Purchaser hereby grants Able Hose & Rubber a security interest in all merchandise (including inventory and equipment) sold, leased, or loaned by Able Hose & Rubber to purchaser, whether now or in the future, to secure payment of the unpaid balance of any invoice (and all charges provided herein), whether now or hereafter outstanding, and Able Hose & Rubber shall have all remedies provided in the Uniform Commercial Code of Minnesota. Purchaser agrees that this Agreement may be filed as a financing statement and/or Able Hose & Rubber may file a UCC financing statement in the jurisdiction in which purchaser is organized or maintains its chief executive office. Purchaser shall be responsible for paying all necessary filing fees.
PLACE OF PAYMENT: Purchaser agrees that all amounts due for merchandise purchased from Able Hose & Rubber are payable at 2340 W. County Rd. C., Ste. 150, Roseville, Minnesota 55113.
JURISDICTION: All merchandise sales will be billed from the state of Minnesota and all orders are subject to final approval of Able Hose & Rubber at its sole option, in the state of Minnesota. Purchaser consents to the jurisdiction of the state of Minnesota and agrees that Ramsey County, Minnesota, is a proper venue for any action arising out of this Agreement and/or the sale of merchandise from Able Hose & Rubber to its purchaser. This Agreement and all sales made hereafter shall be governed by the substantive laws of the state of Minnesota and not by its conflict of law of the state of Minnesota and not by its conflict of law provisions.
PRICING: Invoices reflect price at time of shipment. Pricing may change without notice.
FREIGHT POLICY: All shipments will be made FOB shipping point, and title shall pass at the FOB point. Delivery to the initial common carrier shall constitute delivery to the purchaser. Any claims for loss or damage during the shipments are to be filed with the carrier by the purchaser. Able Hose & Rubber will not assume responsibility for the performance of the carrier. If a partial shipment is made at the purchaser’s request, resulting in a back order, the balance of the order will be shipped collect if it is less than prepaid requirements.
RETURNED PRODUCT POLICY: Able Hose & Rubber will accept no material for return without written authorization, and a return goods authorization number assigned.
- Returned Goods – Defective: Products that are to be returned for final inspection must be returned freight prepaid in the most economical way. Credit will be issued for material found to be defective based on price at the time of purchase.
- Returned Goods – Ordered in Error: All product must be returned freight prepaid and in original packaging. If the product return is accepted, a 15% rehandling fee will apply, plus a charge back for outbound freight charges if the original order was shipped prepaid. Returns are not accepted for any products that are specially manufactured to meet purchaser’s requirements of either specifications or large quantity.
WARRANTIES: Able Hose & Rubber warrants that all products sold by it will be free from defects in workmanship and materials under normal usage for a period of one (1) year. The maximum liability of Able Hose & Rubber, and to any person whatsoever arising out of or in connection with any sale, use or employment of any products or supplies delivered hereunder, whether such liability arises from claims based upon contract, warranty, tort, failure or essential purchase or otherwise, shall in no case exceed the actual amount paid to Able Hose & Rubber for the products delivered hereunder. In no event shall Able Hose & Rubber be liable for lost profits, lost revenues or consequential damages. Except as set forth above, Able Hose & Rubber makes no representations or warranties regarding the products (regardless of whether as to the results to be obtained, infringement or otherwise) and disclaims all implied warranties, whether of merchantability, fitness for specific purpose or otherwise. Able Hose & Rubber published technical information may change without notice due to changes in the industry.
All warranty claims shall be submitted to Able Hose & Rubber in writing within one (1) year from the date of shipment of the products from its factory. Able Hose & Rubber shall then have a reasonable period of time in which to repair or replace the defective products.
This warranty runs only to the original purchaser. The warranty remains valid only if the products are installed and maintained in accordance with all instructions and standard industry practices. The warranty does not apply to damage resulting from corrosion, misapplication, improper specifications or other unanticipated operating conditions.

This Privacy Policy (“Policy”) describes how Singer Equities, Inc., a Virginia corporation, and its subsidiaries, affiliates, and related companies collectively, “Company”, “we”, “our”, or “us”) collects, processes, retains, and discloses personal data about you through our website(s), application(s), product(s), and service(s) (collectively, “Services”) and our practices for using, maintaining, protecting, and disclosing such information.

By using or interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this Policy. Personal Data That We Collect or Process
“Personal data” or “personal data” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, e-mail address, telephone number, home address, or payment information (for example, account information such as name, postal address, and e-mail address, credit card number, social security number, or any other identifier we may use to contact you online or offline). If required under applicable law, we will collect and process personal data constituting sensitive data only with your consent. If you choose not to provide or allow us to collect such information, we may not be able to provide you with certain features, services, or information.

Children’s and Minors’ Data
Our Services are not intended for, and we do not knowingly collect any personal data from, children under the age of 18. If we learn we have collected or received personal data from a child under 18 years old without verification of parental consent, we will delete that information.

We do not control these third parties’ tracking technologies or how they may be used. For example, we may obtain information about you from service providers that we engage to perform services on our behalf, such as payment processors. - Provide you with the Services and any contents, features, information, products, or services that we make available through the Services.

The exact scope of the above-mentioned rights and exceptions thereto vary by state law, and accordingly, we may have no obligation under applicable law to fulfill your request.
How We Protect Your Personal Data
We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. Specifically, e-mail, text messages, and other electronic messages may not be secure, and you should carefully decide what information you send to us via such communication channels. Any transmission of personal data is at your own risk. The safety and security of your information also depend on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.
How We Retain Your Personal Data
We keep the categories of personal data described in this Policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal data. At the end of the retention period, personal data will be deleted, destroyed, or deidentified.
